Terms of Service
These Terms of Service ("Terms") govern your use of the video games developed by Nitroyale Ltd ("Nitroyale", "we", "us"), currently Dirtnap, Silly Walks and Hitty Knife, together with any future games we release (the "Games"). They do not apply to the nitroyale.com website. By installing or playing a Game you agree to these Terms.
1. Store and platform terms
The Games are delivered through third-party stores and platforms such as Steam, the Apple App Store and Google Play. Your purchase, download and use of a Game is also subject to that store's terms, including the Steam Subscriber Agreement, Apple's Licensed Application End User License Agreement and Google Play's Terms of Service. If these Terms conflict with a store's mandatory terms, the store's terms apply to that conflict.
Where a Game is published by a partner (Part Time Monkey Ltd for Silly Walks and Dirtnap, Ketchapp for Hitty Knife), that partner's terms may also apply.
2. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Games for your own entertainment on devices you own or control. The Games are licensed, not sold. All rights not expressly granted remain with Nitroyale and its licensors.
3. Rules of play
You agree not to:
- Copy, modify, decompile, reverse engineer or create derivative works of a Game, except where the law expressly allows it or where we provide official modding tools such as Steam Workshop support.
- Use cheats, bots, exploits, automation or unauthorised third-party software that changes how a Game works or gives an unfair advantage.
- Disrupt or attack game servers, matchmaking or other players' connections.
- Harass, threaten or abuse other players, or use offensive player names or content.
- Sell, rent, sublicense or commercially exploit a Game or your access to it.
- Use a Game in a way that breaks any applicable law.
We may suspend or end your access to online features, or to a Game entirely, if you break these rules. Where a platform such as Steam operates its own anti-cheat or moderation, its decisions also apply.
4. Early Access and updates
Some Games, including Dirtnap, may be offered in Early Access. Early Access Games are unfinished and may change substantially, contain bugs, or be discontinued. We may update, patch, add or remove features and content in any Game at any time, and may require updates to keep playing online.
5. Online features and multiplayer
Online features depend on platform services and internet connectivity we do not fully control. We may modify, suspend or discontinue online features, including servers and matchmaking, with reasonable notice where practical. LAN and offline modes are provided on a best-effort basis.
6. User content
If a Game lets you create or share content, such as maps, mods, player names or Steam Workshop items, you keep ownership of what you make. You grant Nitroyale and its publishing partners a worldwide, royalty-free, non-exclusive licence to host, use, reproduce, display and distribute that content in connection with the Games. You are responsible for your content and confirm that you have the rights to share it and that it does not infringe anyone else's rights.
7. Purchases and virtual items
Payments are handled by the store you use. Prices, refunds and payment disputes are governed by that store's policies. Any in-game currency, unlocks or items are a limited licence to use them within the Game and have no monetary value. They cannot be transferred, sold or redeemed for money, and may be changed or removed when a Game is updated or discontinued.
8. Intellectual property
The Games, including their code, art, music, characters, names and trademarks, are owned by Nitroyale Ltd and its licensors and partners, and are protected by copyright and other laws. Streaming, recording and sharing gameplay videos of the Games for personal, non-commercial purposes, including monetised videos on platforms such as YouTube and Twitch, is permitted and encouraged.
9. Disclaimer of warranties
The Games are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not promise that a Game will be uninterrupted, error-free or compatible with every device.
10. Limitation of liability
To the fullest extent permitted by law, Nitroyale will not be liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Games. Our total liability for any claim relating to a Game is limited to the amount you paid for that Game in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.
11. Termination
You may stop using a Game at any time by uninstalling it. We may terminate the licence if you materially breach these Terms. Sections 6 to 12 survive termination.
12. Governing law
These Terms are governed by the laws of Finland, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Finland, except that consumers in the EU may bring proceedings in their home country and may also use the EU Online Dispute Resolution platform.
13. Changes to these Terms
We may update these Terms when the Games or the law change. The effective date at the top shows the latest version. Continued play after a change means you accept the updated Terms.
